1. Where fresh snow which had accumulated on a two-foot cornice of building during night melted the next day and formed a strip of ice on abutting public sidewalk 24 inches wide and 8 to 18 inches out from building line upon which plaintiff fell and sustained injuries, city against whom action is brought cannot be said to have constructive notice thereof, since patch of ice had not existed sufficient length of time. Evidence going to show that ice patch such as here existed was formed every winter regularly for a number of years held properly excluded as immaterial, since this fact, under the circumstances of this case, would not put the city on constructive notice. In considering liability for ice and snow on public sidewalk, city must not be held to a degree of diligence beyond what is reasonable in view of prevailing climatic conditions in this state. Verdict for city properly directed.
